• Career-related resources and content

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

3. Accounts

To access certain features of the Services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

4. Payment Terms

5. Deliverables & Turnaround

Delivery timelines are estimates based on package selection:

Turnaround times begin once we receive all required materials from you. Delays in providing information may extend delivery timelines. We are not responsible for delays caused by incomplete submissions.

6. Intellectual Property

The Services, including all content, features, functionality, and underlying technology, are owned by KINETK and are protected by intellectual property laws. This includes:

• Our proprietary VANTAGE-7 analysis engine
• Website design, logos, and branding
• Methodologies, templates, and frameworks
• Text, graphics, and other content

Upon full payment, you own the final delivered documents (resume, cover letter, etc.) for your personal use. You may not resell, redistribute, or claim authorship of our templates or methodologies.

7. User Content

You retain ownership of any personal information, resume content, and materials you provide to us ("User Content"). By submitting User Content, you grant KINETK a limited license to use, process, and modify such content solely for the purpose of providing the Services.

You represent that your User Content does not violate any third-party rights and does not contain false or misleading information. You are solely responsible for the accuracy of information provided.

8. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to reverse-engineer or extract our methodologies
• Resell or redistribute deliverables without authorization
• Interfere with or disrupt the Services
• Use automated systems to access the Services without permission

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• That you will receive job interviews or employment
• Specific outcomes from using our Services
• That our Services will be uninterrupted or error-free
• The accuracy of third-party ATS systems or job board requirements

Our success metrics and testimonials represent typical results but are not guarantees of future performance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINETK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OPPORTUNITIES, REGARDLESS OF THE CAUSE OF ACTION.

Our total liability for any claim arising from the Services shall not exceed the amount you paid for the Services giving rise to the claim. Some jurisdictions do not allow limitations on implied warranties or liability for consequential damages, so the above limitations may not apply to you.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Services will cease immediately
• We may delete your account and associated data
• Provisions that by their nature should survive will remain in effect

12. Governing Law
